The Week in Rap Shout-Out Contest

1. SPONSORING ORGANIZATION. 'The Week in Rap Shout-Out Contest' ("the Contest") is sponsored by Flocabulary, Inc. ("the SPONSOR") with an address of 55 Washington Street, Suite 606, Brooklyn, NY 11201.
2. ELIGIBILITY. The contest is open to persons 18 years of age and older. Eligible contestants may submit on behalf of individual students or a group of students. The SPONSOR reserves the right to confirm compliance with eligibility requirements. Entries generated using a script, macro, other automated means, or by any method that interferes with the legitimate fair play of the Contest are void, and Sponsor expressly reserves the right to disqualify and delete any entries that it believes in good faith are in violation of this provision. Entries that are determined, in the sole discretion of the Sponsor to constitute advertisements, commercial messages, or “spam” will be disqualified and deleted. If disqualified, Sponsor reserves the right to terminate the entrant’s eligibility to further participate in this Contest and future promotions and contests of Sponsor or any of its subsidiaries or affiliates. Furthermore, entrants who won in the previous week will not be eligible to win the following week.
3. HOW TO ENTER. Each week entrants will be prompted to ask their students to write a rap or poem about their take on a news story that was covered in the Week in Rap video of that week. To enter, go to flocabulary.com/week-in-rap-contest, and follow the directions to enter. You may submit multiple entries. There is no fee to submit an entry. By submitting an entry to the Contest, each entrant agrees to comply with these Official Rules.
4. WINNER SELECTION. The Contest judge(s) shall be the employees of the SPONSOR or such person(s) selected by the SPONSOR (the "Judge"). The Judge will select one (1) Contest Winner each week at his or her sole discretion. All of the Judge’s decisions are final. For purposes of this Contest, the week will begin at 12:01 AM, EST on Friday and continue until 11:59 PM the following Thursday. The Contest Winner will be notified via email at least one (1) week before the shout-out date, in which the name of the winner's school will be announced in the Week in Rap on Flocabulary.com and on any licensing affiliates. Odds of winning depend on the number of eligible entries received. A list of winners and/or a copy of these official rules may be obtained up to 90 days after the close of this Contest by sending an email to [email protected].
5. GENERAL TERMS AND CONDITIONS. By entering the Contest, each entrant represents and warrants that it has the authority to grant permission to the SPONSOR to use the name of his/her school in The Week in Rap and The Week in Rap Junior music videos and for any and all other promotional purposes without compensation. From time to time, contest may require submission of text, photos, videos or other media ("the Media"). Entrants grant to Sponsor the right to publish, exhibit and distribute the Media in any and all formats. Entrants warrant that Media are original works and that submission is not a violation of rights to privacy, copyright or any other nature. If the Media contains images or video of minors and/or students, entrant represents and warrants that he/she has secured the consent of the depicted individuals' legal guardian for the publication and distribution of image and videos depicting the individual online and in any and all formats by Nearpod Inc. or any of its related entities. Each entrant represents and warrants that he/she meets the eligibility requirements. Entrant agrees to defend and indemnify SPONSOR for any and all claims and liabilities related to above warranties. The SPONSOR reserves the right to terminate, modify or suspend this Contest at any time. SPONSOR is not responsible for lost, late, illegible or incomplete entries, or for technical or human errors or failures of any kind in connection with the submission, transmission, processing or judging of entries. This Contest shall be governed by New York law. By participating in this Contest, entrants agree that New York courts shall have jurisdiction over any dispute or litigation arising from or relating to this Contest and that venue shall be only in New York City, New York. The failure to exercise or enforce any right or provision of these Official Rules shall not constitute a waiver of such right or provision. If any part of these Official Rules is held by a court of competent jurisdiction to be invalid or unenforceable, that part will be enforced to the maximum extent permitted by law, and the remainder of these Official Rules will remain fully in force. By entering the Contest, you will be agreeing that any information collected in connection with the Contest may be used by Sponsor in accordance with Sponsor’s Privacy Policy, a current copy of which can be found at flocabulary.com/privacy-policy/.
